Draft — for counsel review before launch
Version 0.1 (draft), 3 November 2026. Highlighted text marks facts still to be confirmed.
Terms of service
These terms govern your use of Rhumb: the website at rhumbdata.com, its sandbox and its API (together, "the service"). The service is run by Nanner Tech LLC ("Nanner Tech", "we"), a Florida limited liability company. [To be confirmed by counsel: registered office address and company registration number]
By creating an account, using an API key or using the sandbox, you accept these terms. If you accept them for an organisation, you confirm that you can bind it, and "you" means that organisation. Questions go to support@rhumbdata.com.
1. The service
You describe what a model must do and which providers you use; the service answers with the model it judges best suited, named as your provider's API expects it, with its price, capability levels and quality scores from our catalog.
The service only recommends. It does not call the recommended model for you, and your use of any model provider is governed by your own agreement with that provider.
2. Accounts and API keys
- Give a working email address and verify it before you create your first API key.
- Keep your API keys secret. We store only a hash of each key's secret, so we can't show a key again after it is created. If a key may have been exposed, rotate or delete it at once.
- You are responsible for the calls made with your keys and for what your users send through them.
- One account belongs to one person or organisation. Don't open several free accounts to get more free calls.
- The service is meant for developers and businesses. [To be confirmed by counsel: minimum age, and whether consumers may subscribe to paid plans]
3. Acceptable use
When you use the service, you must not:
- Include special categories of personal data in prompts or tags (data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs or trade union membership, genetic data, biometric data used to identify a person, health data, or data about a person's sex life or sexual orientation), or personal data about criminal convictions and offences. The service only needs to know what kind of task you have; describe the task, not the people in it.
- Send content that is unlawful, or that you have no right to send.
- Get around rate limits, quotas, the sandbox's challenge or the sign-up checks, including by using disposable email addresses or many accounts.
- Probe, attack or overload the service, or try to reach data that isn't yours.
- Share your API keys publicly or embed live keys in code that others can read.
[To be confirmed by counsel: whether to add a clause protecting the catalog as a compilation; any such clause must leave reuse of CC-BY and other openly licensed data untouched (section 7)]
4. Free plan, paid plans and billing
- The Free plan includes 1,000 counted API calls per calendar month (UTC) and stops at that quota until the next month.
- Paid plans are monthly subscriptions in US dollars, paid in advance through our payment provider, Stripe. Each plan's price, calls per month, rate limit and number of keys are shown on the pricing page.
- Which calls count against your quota is set out in the documentation (Limits and headers). Test keys don't count against the monthly quota; they have their own daily cap.
- A paid plan's quota follows its billing period. Changing plans closes the current period and starts a new one from that moment; unused calls don't carry over.
- If a payment fails, you keep your paid plan for 7 days while it is retried. If it is still unpaid after that, your account moves to the Free plan's limits.
- You can change or cancel your subscription at any time from the billing page, through Stripe's billing portal. A cancellation takes effect at the end of the period already paid for.
- Refunds: [To be confirmed by counsel: refund policy, including for cancellations mid-period and for account deletion, which ends a subscription at once]
- Taxes: [To be confirmed by counsel: whether prices include sales tax or VAT, and who collects it]
- We may change prices or plan limits. [To be confirmed by counsel: notice period for price changes to existing subscriptions]
5. Answers, prices and scores are provided as is
Answers are produced automatically from public sources and our own curated estimates. Models, prices and benchmarks change often, and a source can be wrong, late or incomplete. In particular:
- Prices are estimates of a typical call from providers' published price lists, converted with published exchange rates. They are not quotes: your provider's bill is what you pay.
- Quality scores come from third-party benchmarks and leaderboards, or are curated tiers marked as estimates. They describe past measurements, not how a model will do on your task.
- Capability levels and context limits are taken from public catalogs and may not match what your provider's account allows.
Check anything that matters before you rely on it. To the extent the law allows, the service, its answers and its data are provided as is and as available, without warranties of any kind, including fitness for a particular purpose, accuracy or availability.
6. Data sources and attribution
Answers include data from third-party sources, and every quality score carries an attribution notice naming its source and licence. If you show or pass on a score, pass its notice on with it. The attributions page lists every source, its licence and its notice, and GET /v1/licenses returns the same list.
7. Your reuse of openly licensed data
Nothing in these terms restricts what you may do with scores or other data that come from openly licensed sources, such as the CC-BY-4.0 scores from LMArena and Epoch AI. Your reuse of that data is governed by its own licence, not by these terms; keep the notices the licence requires. Where these terms and such a licence conflict, the licence wins for that data.
You may use the answers you receive in your own products, including to choose and call models.
8. Your prompts and requests
You keep all rights in the prompts, tags and other content you send. You let us process them only to answer your request. Prompts sent to /v1/plan are read by a decision model from our subprocessor OpenAI, are not stored by us, and are not used by us to train any model. The privacy policy and the data processing addendum say how we handle them.
9. Our property
The service, its software, website, documentation and brand belong to Nanner Tech LLC or its licensors, apart from the third-party data described in sections 6 and 7. These terms give you the right to use the service; they don't transfer ownership of it.
10. Suspension and termination
We may disable an API key or suspend an account, without notice where needed, if it breaks these terms, puts the service or others at risk, or is unpaid after the grace period. A suspended account's keys stop working. We will tell you why by email unless the law or the security of the service prevents it, and restore access once the cause is resolved.
You may stop using the service and delete your account at any time from your account settings. Deleting the account cancels any subscription at once and revokes every key. What happens to your data is described in the privacy policy.
We may end the service or these terms for everyone with notice. [To be confirmed by counsel: notice period for ending the service, and treatment of prepaid periods]
11. Changes to the service
The API is versioned under /v1. Changes within /v1 only add to it, and they are listed in the documentation's changelog. [To be confirmed by counsel: whether to offer a service level or uptime commitment on any plan]
12. Limitation of liability
To the extent the law allows, Nanner Tech is not liable for indirect, incidental, special or consequential loss, or for loss of profits, revenue, data or goodwill, arising from the service, its answers or its data, including costs you incur with a model provider because of a recommendation.
To the extent the law allows, our total liability arising from the service in any 12 months is limited to the amount you paid us for the service in the 12 months before the claim arose. [To be confirmed by counsel: the liability cap amount, and any minimum cap for Free-plan users]
Nothing in these terms limits liability that can't be limited by law, such as for fraud or, where the law says so, for death or personal injury caused by negligence.
13. Governing law
These terms are governed by the laws of the State of Florida, USA. If you're a consumer, you keep any protections the law of your country gives you. [To be confirmed by counsel: courts or arbitration for disputes, and any EU or UK specific provisions]
14. Changes to these terms
We may update these terms. The version and date at the top of this page show when they last changed. We will email account holders before a material change takes effect. [To be confirmed by counsel: notice period for material changes]
15. Contact
